If I acquire a farm in Tyrol, am I required to cultivate it myself?

Von Mag. Martin Fuith, LL.M.

Following the ECJ ruling in Ospelt v Austria, neither living on the farm nor self-cultivation is required of a purchaser relying on the free movement of capital.

Following the judgment of the European Court of Justice in Ospelt v Republic of Austria, a purchaser relying on the free movement of capital is required neither to reside on the acquired agricultural farm nor to cultivate it personally. However, proper cultivation of the land must be ensured.
